This is the last will and testament of me Abraham Slater of Dalton in Furness in the parish of Dalton in the county of Lancaster Yeoman as follows I direct all my just debts funeral and testamentary expenses to be paid by my executors hereinafter named as soon as conveniently may be after my decease

I give devise and bequeath all my real and personal estate and effects whatsoever and wheresoever and of what nature or kind soever whether in possession reversion remainder or expectancy unto my sons William Slater and Robert Slater and my friend Joseph Theckston of Dalton aforesaid grocer and the survivors or survivor of them and the heirs executors and administrators of such survivor

Upon trust to permit my dear wife Grace to have the free use and enjoyment of all my household goods and furniture and permit and suffer her to receive the rents and profits of all my real estate and the interest and dividends of the residue of my personal estate during the term of her natural life she nevertheless keeping my said real estate in repair and insured against damage by fire

And on the decease of my said wife I give and bequeath unto Margaret Jane the child of my daughter Margaret the wife of Laurence Mahon my mahogany bedsteads with the hangings thereto belonging, also the mahogany table [] And I direct my said trustees or trustee after my said wife's decease as aforesaid upon further trust to sell all my said real estate together or in parcels by public auction or private contract upon such terms and conditions as they or he shall deem most expedient and upon receipt of the purchase money to convey the same to the purchaser or purchasers thereof his her or their heirs and assigns And upon further trust to call in sell and convert into money the residue of my household goods and furniture personal estate and effects and with the monies to be realised from such sales calling in and conversion into money in the first place to pay thereout the expenses attendant thereupon, and in the next place pay the following legacies namely: The sum of 40 unto my daughter Grace, the sum of 40 unto William the son of my said daughter Grace (when he attains the age of 21 years), the sum of 60 unto Margaret Jane the child of my said daughter Margaret (when she attains the age of 21 years)

And then as to the residue of the said moneys to divide the same into seven equal parts or shares and pay the same as follows namely: one seventh part or share to Esther the wife of James Atkinson, one other seventh part or share to the children of my late son Abraham, one other seventh part or share to my said son William, one other seventh part or share to my said son Robert, one other seventh part or share to my daughter Agnes, one other seventh part or share to my daughter Elizabeth and the remaining seventh part or share to my said daughter Margaret, to whom I give and bequeath the same respectively And as to the share of my said daughter Margaret I direct that her receipt alone shall be a sufficient discharge to my said trustees for the same And I declare that in case any of my said legatees shall die before me or before his her or their share or legacy shall become due and payable the share or legacy of him and her or them so dying shall go and be paid to his her or their issue and if more than one share and share alike such issue nevertheless taking the part share or legacy his her or their parent or respective parents would have been entitled to if living or in case the legatee or legatees so dying shall have left no issue then to his her or their brothers and sisters and the descendants of those who may be dead per stirpes and not per capita And I further declare that for the purposes mentioned in this clause William the child of my said son Robert and James the child of my said daughter Agnes shall be considered lawful issue and shall be entitled to participate in the event of their parents' death in like manner as the lawful issue of any of my other children And I further direct and declare that the receipt or receipts of my said trustees or trustee for time being... [photocopy incomplete at this point] to them or him shall effectually discharge the person or persons paying the same from seeing to the application or being answerable for the misapplication thereof And I authorise my said trustees or trustee for the time being to apply the whole or part of the income from the share or legacy of any minor for and towards his her or their maintenance and education and add the residue if any of such income to such share or legacy with power to apply such accumulations for future maintenance and education And I hereby further direct and declare that the trustees or trustee for the time being of this my will shall be respectively chargeable only for such monies stocks funds and securities as they shall respectively actually receive notwithstanding their respectively signing or joining in any receipt for the sake of conformity and shall be answerable and accountable only for their own acts receipts neglects or defaults and not for those of each other nor for any banker broker or other person with whom any trust moneys or securities may be deposited nor for the insufficiency or deficiency of any stocks funds shares or securities nor for any other loss unless the same happen through their own wilful default respectively And also that it shall be lawful for the trustees or trustee for the time being of this my will to reimburse themselves or himself or pay or discharge out of the trust monies and premises all expenses incurred in or about the execution of the trusts of this my will and for his and their loss of time and trouble

And lastly I appoint my said sons William and Robert and the said Joseph Theckston joint executors and trustees of this my will and devise to them all estates vested in me as trustee or mortgagee subject to the trusts and equities affecting the same respectively Hereby revoking all former wills by me at any time heretofore made I declare this only to be and contain my last will and testament In witness whereof I the said Abraham Slater the testator have hereunto set my hand this day of in the year of our Lord 1861

Signed published and declared by the said Abraham Slater the testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses the words "and survivor" on the first page having been first interlined and the words "may" "and" and "my" on the same page having been first partly written on erasures
